{"id":18138,"date":"2020-04-16T12:46:36","date_gmt":"2020-04-16T18:46:36","guid":{"rendered":"https:\/\/www.fullcontact.com\/?p=18138"},"modified":"2025-01-06T04:57:52","modified_gmt":"2025-01-06T11:57:52","slug":"ccpa-was-just-the-tip-of-the-iceberg","status":"publish","type":"post","link":"https:\/\/www.fullcontact.com\/blog\/privacy\/ccpa-was-just-the-tip-of-the-iceberg\/","title":{"rendered":"CCPA was just the tip of the iceberg\u2026"},"content":{"rendered":"<h2>More States Enter the Privacy Legislation Space<\/h2>\n<p><span style=\"font-weight: 400;\">Vermont and California may have been the first states to pass and enact legislation creating<\/span><a href=\"https:\/\/oag.ca.gov\/privacy\/ccpa\"><span style=\"font-weight: 400;\"> \u201c<\/span><span style=\"font-weight: 400;\">new consumer rights relating to the access to, deletion of, and sharing of personal information that is collected by businesses,\u201d<\/span><\/a><span style=\"font-weight: 400;\"> but they\u2019re by no means the last.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Some states are creating legislation that\u2019s fairly similar to CCPA. <\/span><span style=\"font-weight: 400;\">In Washington State, the State Senate just passed a bill giving residents new rights over the collection and use of their data, including the right to opt-out of targeted advertising. <\/span><a href=\"https:\/\/www.mediapost.com\/publications\/article\/347174\/privacy-bill-clears-washington-state-senate.html?utm_campaign=Newsletter&amp;utm_source=hs_email&amp;utm_medium=email&amp;utm_content=83802329&amp;_hsenc=p2ANqtz-8y7OWAktGPiixODzwID3gyXfbHpdZTsDoiQNbFGx_0xoxpl00fNAW3OjZ3s6EGftQXJjKczsPZNI2fh4NX4TNGU9GNPDPKY94L67HaQ0TMRkmziHI&amp;_hsmi=83802329\"><span style=\"font-weight: 400;\">MediaPost reports<\/span><\/a><span style=\"font-weight: 400;\"> that <\/span><span style=\"font-weight: 400;\">\u201c<\/span><span style=\"font-weight: 400;\">The bill gives residents the right to access data about themselves, correct errors, delete the information, and opt-out of having their data used for ad targeting and profiling.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Other states are taking on consumer protection in very specific instances. Recent developments include New York\u2019s adoption of Privacy and Security regulations focused on schools and school vendors. JD Supra reports that the <\/span><a href=\"https:\/\/www.jdsupra.com\/legalnews\/new-york-adopts-new-data-security-and-64996\/?utm_campaign=Newsletter&amp;utm_source=hs_email&amp;utm_medium=email&amp;utm_content=83802329&amp;_hsenc=p2ANqtz-8y7OWAktGPiixODzwID3gyXfbHpdZTsDoiQNbFGx_0xoxpl00fNAW3OjZ3s6EGftQXJjKczsPZNI2fh4NX4TNGU9GNPDPKY94L67HaQ0TMRkmziHI&amp;_hsmi=83802329\"><span style=\"font-weight: 400;\">New York State Department of Education <\/span><\/a><span style=\"font-weight: 400;\">is moving forward with regulations that \u201c<\/span><span style=\"font-weight: 400;\">require school districts and state-supported schools to develop and implement robust data security and privacy programs to protect any personally identifiable information (\u201cPII\u201d) relating to students, teachers and principals.\u201d Each school will provide a Parental Bill of Rights, designate a Data Protection Officer (DPO), along with other additional stipulations.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Iowa hopes to tackle privacy from another direction, with a bill intended to create a sort of statute of limitations for social media posts. State Senator Zach Nunn is pushing for a \u201cright to be forgotten act,\u201d which <\/span><a href=\"https:\/\/www.thegazette.com\/subject\/news\/government\/iowa-legislature-zach-nunn-carson-king-right-to-be-forgotten-bill-internet-privacy-20200218?utm_campaign=Newsletter&amp;utm_source=hs_email&amp;utm_medium=email&amp;utm_content=83802329&amp;_hsenc=p2ANqtz-8y7OWAktGPiixODzwID3gyXfbHpdZTsDoiQNbFGx_0xoxpl00fNAW3OjZ3s6EGftQXJjKczsPZNI2fh4NX4TNGU9GNPDPKY94L67HaQ0TMRkmziHI&amp;_hsmi=83802329\"><span style=\"font-weight: 400;\">the Gazette reports<\/span><\/a><span style=\"font-weight: 400;\"> is intended to \u201cauthorize Iowans to request that certain content be removed from the internet.\u201d The content would not be purged if \u201c<\/span><span style=\"font-weight: 400;\">include information related to criminal convictions, litigation relating to a violent crime or a matter that is of significant public interest.\u201d<\/span><\/p>\n<h2>Not All Look Forward<\/h2>\n<p><span style=\"font-weight: 400;\">Not all states are moving in the right direction. Tennessee currently made news for selling PII. <\/span><a href=\"https:\/\/fox17.com\/news\/local\/personal-information-of-72-million-tennessee-drivers-sold-to-companies-by-state-agency?utm_campaign=Newsletter&amp;utm_source=hs_email&amp;utm_medium=email&amp;utm_content=83802329&amp;_hsenc=p2ANqtz-8y7OWAktGPiixODzwID3gyXfbHpdZTsDoiQNbFGx_0xoxpl00fNAW3OjZ3s6EGftQXJjKczsPZNI2fh4NX4TNGU9GNPDPKY94L67HaQ0TMRkmziHI&amp;_hsmi=83802329\"><span style=\"font-weight: 400;\">Fox17 Nashville discovered<\/span><\/a><span style=\"font-weight: 400;\"> that the state\u2019s Department of <\/span><span style=\"font-weight: 400;\">Safety and Homeland Security, which oversees and regulates driver\u2019s licenses, sells resident information to the tune of $1,000,000 in annual revenue. The article notes that Tennesseans are notified of the collection when they apply for licenses: \u201cwedged in the middle of the form is a question asking for consent to release your personal information from your driver&#8217;s record. Although you can refuse to give consent for release when it comes to \u2018individual lookup\u2019 or for \u2018mailing advertising,\u2019 Tennesseans cannot block release for other reasons.\u201d And though there\u2019s an opt-out option on the form, it\u2019s a bit misleading. Fox17 Nashville found that residents actually have to go to each of the five companies buying their data and opt-out individually because the opt-out covers people buying data, not companies.<\/span><\/p>\n<h2>What&#8217;s Next in Privacy Legislation?<\/h2>\n<p><span style=\"font-weight: 400;\">With various states enacting their own take on CCPA, it\u2019s possible the landscape will become tangled and confusing. But another solution could be on the horizon. At least one U.S. Senator wants to make it easier for everyone. <\/span><a href=\"https:\/\/techcrunch.com\/2020\/02\/13\/gilliband-law-data-agency\/\"><span style=\"font-weight: 400;\">TechCrunch reports<\/span><\/a><span style=\"font-weight: 400;\"> that Senator Kirsten Gillibrand is putting forth a bill to \u201ccreate a U.S. federal data protection agency designed to protect the privacy of Americans and with the authority to enforce data practices across the country.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While having one institution and set of regulations would be easier to navigate than 50, we know when it comes to data privacy, the arena is complex and ever-evolving<\/span><span style=\"font-weight: 400;\">.
